1) Introduction
These Terms of Service apply to all the services advertised on this site. All information, descriptions or images that are provided about the services are as accurate as possible. However, Chalet Studio is not legally bound by such information, descriptions or images as Chalet Studio cannot guarantee the accuracy of all the services provided. You agree to purchase services from Chalet Studio at your own risk.
Chalet Studio reserves the right to reject or cancel your project whenever it becomes necessary. If your project is rejected before any work begins on your project and your payment has already been processed, a refund equal to the amount paid will be issued. You agree that it is your responsibility to monitor your payment method to verify receipt of any refund. If your project is cancelled after work has commenced on your project, a refund will not be issued.
By booking time at Chalet Studio, or by contracting offered services, you agree to these Terms of Service.
2) Agreement Language
In this agreement, certain language or terms may be used, and their definitions should be considered by the definitions outlined in this section of the agreement. All terms not elaborated upon here are to be read at face value.
i. Client(s); refers to any artist, musician, filmmaker, engineer, producer, director, business or corporate entity, customer, or potential customer in communications with Chalet Studio for services.
ii. Session(s); refers to any file or document with an extension used with DAWs (Digital Audio Workstations) such as Pro Tools, Logic, Ableton, Cubase, Adobe, or any other DAW or software used to provide services by Chalet Studio.
iii. Raw Audio; refers to audio recorded at Chalet Studio or sent to Chalet Studio before anything has been done to alter it in any way (such as but not limited to editing, mixing or mastering).
iv. A&R(s); refers to the division of a record label or music publishing company that is responsible for talent scouting and overseeing the artistic development of recording artists and songwriters.
v. Collaborated Content; refers to any media sent to Chalet Studio to be edited, mixed, have instruments played on, or have production services supplied for.
2. Words appearing in this section may appear italicized throughout the agreement to remind the reader that they may find a definition in this section.
3. Words appearing in this section may also appear with reference to their definition in parentheses. This does not limit the definition of the word to the portion shown in parentheses. All words appearing in this section should be held to the full definitions provided in Section 2 "Agreement Language" of this agreement. No parentheses will contradict any definition in this section.

4) Cost
The standard Studio Rate is $90/hour + HST. This includes the cost of a recording engineer or videographer.
Additional Staff or Personnel will be billed in addition to the studio rate (See section 6).
Clients will be billed in CAD.
Set-up and tear down before and after a session are considered part of the booked session, and will be billed in addition to the studio time dedicated to working on a project. Clients may or may not choose to be present for session setup and/or teardown, but will be billed for this time regardless.
For clients using the space for independent video production who do not require any equipment or camera operation from Chalet Studio staff, the studio space can be rented (excluding the control room and studio grounds) for 10 hours at a flat fee of $500 + HST. This fee does not include the use of any Chalet equipment (audio or video), instruments, personnel or any audio recording. Use of the grounds is subject to availability and will be billed at an additional rate to the video flat day rate.
Discounts
Any discounts on services Chalet Studio offers or provides are at the sole discretion of Studio Management.
Accommodations Costs
Clients purchasing services from Chalet may receive discounted accommodation costs from Chalet Claremont Bed and Breakfast.
$75 + HST per musician per night. Subject to availability.
If you stay for a week or longer, you will receive a 10% discount in addition to the already discounted rate for accommodation.
Changes to Cost
These prices are subject to change without notice, with the exception of a pre-existing agreement; projects with a pre-existing agreement will not be affected by the price change until after their completion.
5) Additional Costs
While you are using Chalet Studio services, other services may be required to complete your projects. These additional services include but are not limited to session musicians, external producers or engineers, additional personnel (assistant engineers, extra camera operators for multi-camera video shoots, etc.), equipment rentals, instrument rentals, and instrument care products (new guitar strings, guitar setup, new drum skins, etc.). These services are an additional cost that is not included in any service provided by Chalet Studio.
For larger sessions, catering can be arranged at an additional cost. Cleaning up from catering is the client's responsibility. Chalet Studio offers a full kitchen, but clients are expected to bring their own food.
6) Payments
Chalet Studio accepts Interac e-transfer, cash, debit, credit card (Visa, Mastercard and American Express) or a bank draft for services provided. For agreed-upon corporate clients, Chalet Studio will also accept a direct deposit or wire transfer. Cheques are not accepted.
To make your payment via e-transfer, please send to studio@chalet.com. Please include your invoice number in the comments section before sending the e-transfer. Failure to include the invoice number may cause delays in payment processing. No password is required as auto-deposit is enabled.
To make a payment via Bank Draft, please make the Bank Draft Payable to Chalet Studio. Chalet Studio is not responsible for any fees associated with having a bank draft created.
Invoice payments are due in full within 5 days of receipt of the invoice, unless otherwise agreed upon in writing.
Unless otherwise agreed upon in writing, overdue invoices are subject to a 25% late fee per month until the invoice is paid in full.
A 50% deposit must be paid to hold all bookings. The remaining balance will be due upon the completion of the session. Any incidental fees (such as, but not limited to, extra studio time) will also be due at this time.
You will not be able to download, nor will you receive any completed work, until the balance owed is paid in full.
7) Refunds
Chalet Studio does not provide refunds for services previously provided, as the services require variable amounts of substantial time. If you are unsatisfied with the services provided, you may contact our management to rectify the situation. In certain circumstances, rectifying the situation may result in additional costs to the client from a 3rd party.
Refund eligibility for additional costs, such as a session musician, equipment rental, etc. must be negotiated with that affiliate and not with Chalet Studio. Chalet Studio makes no guarantee that the affiliate will issue a refund.
Booking Cancellation Refunds
For session cancellations with more than 72 hours' notice, a full refund will be issued to the client.
For session cancellations with 72-48 hours' notice, a refund will not be issued, but the deposit may be re-allocated to a future session.
For session cancellations with 48 hours' notice or less, no refunds will be issued, and the deposit will not be re-allocated to any future session.
Exceptions to this policy are at the sole discretion of studio management.
8) Conduct and Additional Studio Policies
At Chalet Studio, we prioritize fostering a respectful and positive environment for both our staff and clients. Success hinges on maintaining a culture of mutual respect, professionalism, and dignity in all interactions. This policy outlines the expected behaviour of clients towards our staff to ensure a productive relationship.
Clients are expected to behave professionally. Chalet Studio reserves the right to terminate a session without refund if there is any misconduct. Abusive or aggressive behaviour will not be tolerated.
Clients are liable for any damage caused to studio equipment or premises.
Chalet Studio is a scent-free studio. All employees, clients and visitors are asked not to wear or use scented products while at the studio whenever possible. If any employees, clients and/or visitors continuously violate this policy, Chalet reserves the right to ask the person to leave and not return until the scent is gone. Should this occur, no refunds will be issued.
Chalet Studios' standard hours of operation are 8 AM to 11 PM. Due to local ordinance and out of respect for those staying at Chalet Claremont Bed and Breakfast, there is a sound curfew that begins at 11 PM. Recording of instruments such as but not limited to drum kits, percussion, electric guitars, electric bass and amplified instruments is not permitted after this curfew.
Accommodations Policies
Artists who are staying overnight at Chalet Studio’s Chalet Claremont Bed and Breakfast must adhere to the policies laid out in the “Policies and Payment” section of Chalet Claremont’s website.
Accommodation guests are also subject to the scent-free policy
Guests must conduct themselves in a fashion that is amenable to the other guests who may be staying at the facility.
The trails on the Chalet Studio grounds and the in-ground pool are not supervised and are to be used at your own risk. Chalet Studio, nor Chalet Claremont, will be held liable for any damages or injuries as a result of outdoor facilities use.
Check-in is at 4 PM and check-out is at 12 PM the following day.
9) Audio Mixing Terms of Service
Chalet Studio offers professional mixing services for projects by unsigned artists, record labels, A&Rs, signed artists, and corporate-funded projects. All clients must agree and accept the terms outlined in this section.
Chalet Studio does not own any portion or rights of the song/project the team is contracted to mix, unless otherwise agreed upon in writing, i.e. email or contract outside of this agreement. The client remains in full control and ownership of produced media, including the following:
a. Final unmastered mixes bounced to MP3 or WAV format
b. Instrumental versions
c. Audio stems of separate musical or audio elements
d. Vocal tracks
e. Edited vocals
f. Final audio for film
g. Instrumental performances
2. Chalet Studio does not turn over mix sessions to any client unless otherwise clearly agreed upon through email or contract. These sessions contain techniques and strategies for mixing, editing, and production that are not available to be shared with the general public or clients of Chalet Studio. These are considered trade secrets, and the client agrees they will not demand the session and trade secrets at any point leading up to and including completion of the project.
3. Chalet Studio reserves the right to store and keep files affiliated with projects purchased, audio uploaded, and audio reviewed with/by Chalet Studio. The content will remain in compliance with the privacy policy and this agreement. Chalet Studio is not responsible for archiving the media after project completion.
4. Chalet Studio reserves the right to use final mixes in the audio portfolio of the website, www.chaletstudio.com. This will be allowed under the terms of the "Online Portfolio Agreement.” Chalet Studio may also use final mixes or refer to them in other business prospects, portfolios, or resumes distributed to potential employers or collaborators.
5. Chalet Studio may also use project audio for ‘before and after’ samples on the website for potential clients to hear the quality of work provided. Unsigned artists agree to this by purchasing services. If the client is a signed artist, they must read and agree to the terms outlined in Clause 1, Section 9 (Additional Audio Mixing Terms of Service for Record Labels) of this agreement.
The artist or client may request, by e-mail, that either:
a. The vocals used in the ‘before’ option are tuned to preserve a certain image of the singer.
b. The before clip be removed entirely to preserve the image of the project.
6. Raw files stored may be shown in private for seminars or review by potential business collaborators. Chalet Studio reserves the right to show raw audio and finished audio under these circumstances without permission beyond this agreement.
7. For clients only contracting mixing services from Chalet Studio, a "Mix Submission Form" must be filled out prior to the commencement of any mixing. Each client will need to fill out one form per song in the project. See section "Mix Submission Form."
8. Upon project completion, before final payment is made, each client must submit a "Mix Approval Form". Each client will need to fill out one form per song in the project. See section "Mix Approval Form."
10) Additional Audio Mixing Terms of Service for Record Labels
This section of the agreement outlines additional terms of service specific for record labels, A&Rs, signed artists, and corporate-funded projects for mixing services.
Chalet Studio may only use project audio for ‘before and after’ samples on www.chaletstudio.com if the client agrees to it through e-mail or contract. Without that permission, Chalet Studio may only post audio under the "Online Portfolio Agreement" of this agreement. ‘Before and after’ content is used for potential clients to hear the quality of work provided.
Even after agreeing to be used for ‘before and after’ content, the client may at any time after request by e-mail that either;
a. The vocals used in the before option are tuned to preserve the image of the singer.
b. The before clip be removed entirely to preserve the image of the project.
11) Audio Mixing Terms of Service Exceptions
Clause 1, Section 8 (Terms of Service for mixing):
i. If Chalet Studio or one of its staff is also a co-writer or co-composer of the song, Clause 1 is null and void and the ownership and royalties terms are spelled out in a separate “Single Songwriter Collaboration Agreement.”
ii. If Chalet Studio or one of its staff is also the Producer or Co-Producer of the song, Clause 1 is null and void and the ownership and royalties terms are spelled out in a separate “Music Production Agreement.”
iii. If Chalet Studio or one of its staff is both a co-writer or co-composer AND the producer or co-producer, Clause 1 is null and void and the ownership and royalties terms are spelled out in a separate “Music Production Agreement”: Section 2 "Ownership" and Section 13 "Exceptions."
12) Video Services Terms of Service
Chalet Studio offers professional video services for projects by individuals, unsigned artists, record labels, A&Rs, signed artists, and corporate projects. All Clients must agree and accept the terms outlined in this section.
Chalet Studio does not own any portion or rights of the project contracted unless otherwise agreed to in written form, i.e. email or contract, outside of this agreement. The client remains in full control and ownership of the produced media.
Chalet Studio reserves the right to store and keep files affiliated with projects contracted, video uploaded, and video reviewed with/by Chalet Studio. The content will remain in compliance with the privacy policy and this agreement. Chalet Studio is not responsible for archiving the media after project completion.
Chalet Studio reserves the right to use final versions in the video portfolio of the website www.chaletstudio.com. This will be allowed under the terms of the "Online Portfolio Agreement.” Chalet Studio may also use final versions or refer to them in other business prospects, portfolios, or resumes distributed to potential employers or collaborators.
Raw files stored may be shown in private for seminars or review by potential business collaborators. Chalet Studio reserves the right to show raw video and finished video under these circumstances without permission beyond this agreement.
13) Music Production Terms of Service
Chalet Studio offers professional music production services for songs and projects by unsigned artists & clients, record labels, A&Rs, signed artists, and corporate-funded projects. The music production Terms of Service are subject to the hired producer’s Terms of Service.
14) Single Song Co-Writing Agreement
When a client contracts Chalet Studio and its staff for song co-writing services, the client must complete a “Single Song Co-Writing Agreement”.
The "Single Song Co-Writing Agreement" is a legally binding contract that outlines the ownership and royalties split of a song co-written by two people. When a client contracts Chalet Studio or one of its staff to co-write and/or co-compose a song, this contract will state that Chalet Studio or one of its staff and the Client enter into an agreement to sell certain publications and any other marketable rights in and to the song specified in the agreement. You will not be able to purchase song co-writing services without agreeing to this.

15) Mix Submission Form
The "Mix Submission Form" is a legally binding service agreement that all clients must complete prior to the commencement of any mixing of your project, unless otherwise stated in writing. The "Mix Submission Form" provides Chalet Studio and its engineers with essential information about the project, informs the client how Chalet Studio would like to receive your session for mix, and outlines additional Terms of Service specific to the Audio Mixing Service. Each client will need to fill out one form per song in the project. Clients who have had their project produced and/or recorded at Chalet do not need to complete this form.

16) Mix Approval Form
The "Mix Approval Form" is a legally binding contract that all clients must complete upon the completion of the Mixing of their Project, prior to receiving any of their Deliverables. This contract is where the client will specify which deliverables they are requesting in addition to the deliverables included.
This contract will also serve as a declaration from the client that they are satisfied with the work completed, and the project is now complete. The form also states that if a client requests additional revisions or deliverables at a later date, it will be subject to an additional Audio Mixing Fee for revisions and additional hourly billing for deliverables.

17) Audio Restoration
Audio Restoration refers to the concept of taking damaged audio and restoring it, cleaning it up and/or improving the recording.
Audio may be damaged in various ways including, but not limited to:
i. Excessive noise
ii. Ambient reverb
iii. Clicks
iv. Pops
v. Metronome bleed
vi. Digital impulse noises
vii. Background rustling of clothes
viii. Wind
ix. Clipping/distorting
x. Electrical hum
xi. Radio interference
Chalet Studio can provide usable audio for situations such as court cases, depositions, or legal documentation. While Chalet Studio and its staff have a variety of tools, algorithms, and software to provide this service, we are limited by the capabilities of technology. Providing results of the quality needed for a music or film/television situation will vary from project to project.
18) Online Portfolio Agreement
By contracting Recording, Production, Mixing or Composition services, you consent to have your finished project showcased on Chalet Studio's website after the project has been released to the public. The featured project will be displayed with the artist's name, a copy of the album artwork, or a picture of the artist retrieved through the internet, Chalet Studio's role(s) in the project, as well as streaming and purchase links. If a music video is released alongside the project, a link to the official video will also be posted.
The project will be featured at www.chaletstudio.com/pastaudio.
Prior to your project’s release, Chalet Studio and its staff reserve the right to use your project for resumes and portfolios.
However, it will only be used in a private setting and not posted publicly on Chalet Studio's website.
19) Third-Party Agreements
Chalet Studio uses third-party services and/or applications to provide some services. You are responsible for reading and understanding any Third-Party Terms before accessing or using any Third-Party Services and/or Applications. You acknowledge and agree that Chalet Studio is not liable for any Third-Party Services and/or Applications. By hiring or contracting services from Chalet Studio, you are also agreeing to these Third-Party Service’s and/or Application’s Terms of Service/Terms and Conditions.
A list of all the Third-Party Services and/or Applications used by Chalet or its staff is available upon request.
20) Consumer Protection Law
Where the Consumer Protection Act or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms of Service will not limit your legal rights and remedies under that legislation. These Terms of Service will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms of Service and that legislation, the mandatory provisions of the legislation will apply.
21) Limitation of Liability
Chalet Studio and any affiliates will not be liable for any actions, claims, losses, damages, liabilities or expenses, including legal fees, arising out of the services provided.
22) Indemnity
Except where prohibited by law, by contracting Chalet Studio to perform the services listed on this site, and by using this website, you indemnify and hold harmless Chalet Studio and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of the provided services, use of this site or your violation of these Terms of Service.
23) Applicable Law
These Terms of Service are governed by the laws of the Province of Ontario in Canada.
24) Severability
If at any time any of the provisions set forth in these Terms of Service are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms of Service. All other provisions will not be affected by the removal, and the rest of these Terms of Service will still be considered valid.
25) Changes
These Terms of Service may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way Services are provided and the way Chalet Studio operates this website. Chalet Studio reserves the right to make updates or changes to this agreement without notice.
